These terms set out the terms upon which you may make use of this website and govern your use of the services we (Wayra Tarifa) provide through this website. By using our website you acknowledge and confirm that you accept these terms and agree to comply with them. Please read these terms carefully before using the website.

Our services

We provide holiday rental accommodations for guests.

We do not warrant that our website or its content or functionality will always be available or uninterrupted or that it is free of viruses. We may suspend, withdraw, discontinue, change or modify all or any information at any time without notice and we shall not be liable if for any reason the website or any part of it is unavailable at any time.

The content is provided for general information only and is not to be relied on. Although we make all reasonable endeavours to keep the information up to date, no representations, warranties or assurances, whether express or implied, are given that it is complete and accurate. Furthermore we are not responsible for any information provided to you directly or indirectly. Any arrangements that you negotiate with us are your sole responsibility and we accept no liability in relation to any such arrangements to you or any third party.

We reserve the right to accept or reject any application for bookings and accommodations and we reserve the right at our sole and complete discretion to reject any application made via this website.

Property Rights

We own or are the licensee of all intellectual property rights in our website and its content. These rights are protected by law and you may not copy or download any content or extract from the website other than for your own personal use or with our express written consent. In the case of downloaded information you may not modify or use the same and you shall indemnify us against any liability that we may incur through your use or modification of such information or your misuse of this website.

You may only use this website for lawful purposes and you shall indemnify us and keep us indemnified against any unlawful or fraudulent use and any breach of applicable local, national or international laws and regulations.

Limitation of Liability

Under no circumstances shall we be liable for any loss or damage caused by your reliance on information obtained through this website, its content or the services we provide. It is your responsibility to evaluate the accuracy , completeness and usefulness of the website, its content and the services and in no event shall we be liable for any damages whatsoever in respect of your use of the website or our services or any transaction that you enter into with an accommodation owner following use of this website.

Payment

The initial payment required to secure a reservation depends on the individual property and is non- refundable. This payment should be made to the account given. We expect the deposit payment to be paid within 48 hours of receiving the relevant bank details, no booking is secure without receipt of the payment and a booking can be considered as cancelled if the payment has not been received within this time frame.

In the cases where a balance payment is required prior to arrival we expect for this payment to arrive on time and this will be stipulated at the time of booking, Wayra Tarifa are entitled to treat your booking as cancelled if you fail to pay the balance on time.

Security Deposits

If applied a security deposit is required to cover the cost of any damage or breakages to, or at the property. Wayra Tarifa reserve the right to refuse entry to the property should the security deposit not have been paid.

We shall be allowed access to inspect the property prior to your departure.

In the case of any damage or breakages, the security deposit will be kept whilst waiting for estimates for repaid or damage.

You are responsible for keeping the property and all its contents in the same state of cleanliness, repair and condition as at the commencement of the holiday. You will be responsible for the payment of any breakages, loss or damage caused by you, your guests or members of your family. Wayra Tarifa reserves the right to make deductions from the security deposit for any extra cleaning, over the number of hours committed to departure cleaning, and to claim against you for damage or loss, if the cost of which exceeds the security deposit.

If you cancel or amend your booking

If you need to cancel or amend your Booking you must write to us or email as soon as possible. A cancellation or amendment will not take effect until we receive confirmation from you.

The effective date of cancellation is the date we receive written notification. If you cancel 2 weeks or more prior to your arrival at the property you will lose your deposit. If you cancel less than 2 weeks before your arrival at the property, or the booking is cancelled due to your non- payment, Wayra Tarifa shall be entitled to the full cost of the holiday from you. Security deposits are fully refundable in the event of cancellation by you. No refund shall be refunded unless Wayra Tarifa is able to re-let the property for the same terms, in which case a full refund shall be repaid to the client (less administration charges).

If the balance payment is not paid in accordance with the time frames set out at the time of the Booking we shall be entitled to treat your booking as cancelled by you.

If you do not arrive at the property within 24 hours of your arrival time without notifying us, we will consider your booking as cancelled by you.

If the owner cancels or amends your booking

In the unlikely even of a significant change or cancellation of your booking by Wayra Tarifa, we will inform you as soon as possible. If requested and if available we will try to arrange alternative accommodation at a similar price, standard and location. In the event that no suitable alternative can be found, we shall refund to the client in full the client’s deposit and any such other sums as the client may have paid to Wayra Tarifa and we shall have any further liability whatsoever to the client or his/her party.

The Property

You can arrive at the Property after the time specified by us on the arrival date for your holiday and you must leave by the time specified by us on the departure date we give you. We will let you know these times in writing in advance of your stay.

You must vacate the property by 12pm on the day of departure unless other arrangements have been made directly with Wayra Tarifa. Failure to do so will result in money being taken out of the security deposit.

Upon departure it is the guests’ responsibility to ensure that all keys are left at the property or at the locked box (specific accomodation check-out arrangement will be provided to you). An administration charge and replacement value of lost items will be deducted from the security deposit in this incidence.

Your obligations

You agree to comply with the regulations set out in any property manual at the Property and any other regulations reasonably specified by us and ensure that they are observed by all members of your party. You agree to keep and leave the Property and the furnishings, including items such as kitchen equipment, crockery and glasses clean and in good condition.

Wayra Tarifa reserves the right to make deductions from the security deposit for any extra cleaning, over the number of hours committed to departure cleaning, and to claim against you for damage or loss, if the cost of which exceeds the security deposit.

You agree to take all necessary steps to safeguard your personal property while at the Property.

You agree to ensure that each member of your party is covered by comprehensive travel insurance (including cancellation, flight delays, loss and damage to baggage and other property) and health insurance (including evacuation and repatriation coverage).

You cannot allow more people to stay in the Property than expressly authorized, nor can you significantly change the make up of the party during your stay in the Property, nor can you take your pet into the property unless permitted by us in writing in advance. If you do so, we can refuse to hand over the property to you, or we can require you to leave it. We will treat any of these circumstances as a cancellation of the booking by you and we shall be under no obligation to refund you for any fees already paid to us in those circumstances. Any refund will be our sole discretion.

You agree to allow us or any representative of ours access to the Property at any reasonable time during your stay for the purpose of essential repairs, in an emergency or to ensure you are complying with this Booking Contract.

Complaints

Every effort has been made to ensure that you have an enjoyable and memorable holiday. If however you have any cause for complaint it is important that remedial action is taken as soon as possible.

It is essential that you contact us if any problem arises so that it can be speedily resolved. It is often extremely difficult (and sometimes impossible) to resolve problems properly unless we are promptly notified. Discussion of any criticisms with us whilst you are in residence at the Property will usually enable shortcomings to be rectified straight away. In particular, complaints of a transient nature (for example, regarding preparation of the Property) cannot be investigated unless registered whilst you are in residence at the Property.

If any complaint cannot be resolved during your holiday, you must write to us or email us with full details within 28 days of the end of your Booking.

Location of the Wayra Tarifa accomodations

Please familiarize yourself with the location of the property you would like to rent prior to your booking. A google map can be found on each accommodation website with this information..

Should you wish any extra cleaning we are happy to help to arrange.

Wayra Tarifa reserves the right to make deductions from the security deposit for any extra cleaning, over the number of hours committed to departure cleaning, and to claim against you for damage or loss, if the cost of which exceeds the security deposit.

Air Conditioning

Where applicable as only a few of the properties have air conditioning. Air-conditioning will only be effective if all doors and windows are closed whilst it is running. We cannot be held responsible for non- effective air conditioning if this simple procedure is not followed. The air-conditioners are extremely effective and cool a room down in minutes. In the interests of saving energy, we strongly recommend that the air-conditioners be turned off when leaving the room.

Condition of the Facilities

Wayra Tarifa shall not be liable for any defect in or the breakdown of any mechanical, electrical or other item of equipment, goods or property, including the property itself or the swimming pool. However upon becoming aware of the defect we shall endeavour to effect repairs to / or the replacement of any such item within a reasonable time frame. The client shall not be entitled to any compensation whatsoever in respect thereof.

We cannot be held responsible for the failure of public utilities such as water and electricity. We cannot be held liable for any malfunctions or technical problems with Internet Service Providers.

Noise

We cannot be held responsible for noise or disturbance originating beyond the boundaries of the property or which is beyond our control.

Animals, bugs etc

Wayra Tarifa shall not in any way be liable for the occasional appearance at Wayra Tarifa  property of insects, vermin or animals, but shall endeavour to limit or eradicate the same when notified of their presence.

Safety

Upon arrival at the property you and all members of your party must take time to familiarise yourselves with the location and layout of the property. Telephone numbers for the emergency services are given to all guests in the information packs.

Smoking

All accommodations have a strict no smoking inside..

Website Content and Photos

All content and photos are the ownership of Wayra Tarifa.

A breach of the Terms and Conditions

In the event of a breach of the above terms and conditions by the client, Wayra Tarifa may in their absolute discretion terminate the agreement forthwith, and the client shall be liable to compensate us for any loss or damage incurred.
